General Terms of Registration and Course Conditions of the Amsterdam Summer University Foundation.
0.) Definitions
0.1.) AMSU: The Amsterdam Summer University Foundation, known as The Amsterdam-Maastricht Summer University.
0.2.) Course Participant: A person who has applied for one or more of the courses offered by the AMSU.
0.3.) General Terms: These General Terms of Registration and Course Conditions.
1.) Range of application of the General Terms
1.1.) These terms are applicable to all applications and to all courses provided by the AMSU.
1.2.) By completing and submitting the AMSU online application form, the course participant agrees to the applicability of these General Terms.
2.) Application
2.1.) Application for one or more courses can only be made by filling in completely the application form and submitting it to the AMSU. The AMSU will confirm the receipt of the application in writing/email at the earliest opportunity and will send additional instructions for the necessary payment of the course fee.
2.2.) All personal information provided to the AMSU will be treated confidentially and will not be disclosed to third parties without previous written consent of the concerned party.
3.) Placement
3.1.) If the number of applications received by the AMSU for a particular course exceeds the maximal number of participants, selection is made on a first-come, first-served basis.
3.2.) For those courses indicated in the website requiring the course participant to submit a curriculum vitae and/or letter of motivation, selection is made on the basis of suitability, to be assessed exclusively by the AMSU, and then on the basis of the provisions contained in article 4.1.
3.3.) An applicant who is not selected will be notified in writing/email, with reimbursement of any course fee that has been paid.
4.) Payment
4.1.) Payment of the course fee is made at the same time as the application, apart if the course requires a selection process. If a selection process is required, the course fee payment is due from the moment that the applicant is notified of having been selected. The participant has no right to participate in the course(s) until the course fee has been received by the AMSU and the course participant's obligation to pay the course fee remains.
5.) Cancellation
5.1.) Cancellation of participation in a course can only be made in writing.
5.2.) Participants are entitled to a period of reflection of 14 days from the submission of an application form. If the application is made less than 14 days before the beginning of the course the period of reflection is until 24 hours before the beginning of the course. If a cancellation is made during the period of reflection the applicant bears no financial obligation towards the AMSU. After the period of reflection the cancellation fee rules applies.
5.3.1.)If the cancellation is made no later than fourteen days before the commencement of the course concerned, 15% administrative expenses will be deducted.
5.3.2.) If the cancellation is made later than fourteen days before the commencement of the course concerned, the course participant is not entitled to refund of the course fee. However, if the course participant has received confirmation of participation in the course less than fourteen days before the commencement of the course, the course participant is entitled to cancel the course within seven days, in accordance with the provisions contained in articles 6.1 and 6.2. The course participant may allow another participant to take his or her place, provided he/she informs the AMSU of this in writing at least one week before the commencement of the course. If a selection is made for the course, the course participant can propose another person. The selection of the latter will be made on the basis of suitability, as assessed by the AMSU.
5.4.) Cancellation of accommodation can only be made in writing.
5.5.) If cancellation is made regarding hotel or apartment accommodation that has already been confirmed by the AMSU, the AMSU will try to find a replacement tenant. If the cancellation of the hotel reservation is made later than seven days before arrival, the cost of the first night of accommodation may be charged. If the cancellation of the apartment reservation is made later than seven days before arrival, and in the event that the AMSU is unable to find a replacement tenant, the total cost for the reserved nights may be charged. Any changes requested by the course participant with regard to the accommodation confirmed by the AMSU cannot be guaranteed.
5.6.) The AMSU retains the right to cancel a course if there are not enough applicants, without obligation in any way to make compensation. In such a case the AMSU will inform the course participant (in writing) as soon as possible and will repay the course fee if it has already been paid. Reimbursements will be made within 1 month.
6.) Amended Terms and conditions relative to the Erasmus + courses.
6.1) Application/Pre-registration relative to the Erasmus + courses:
The completion of the AMSU pre-registration form for Erasmus + courses does not guarantee a place in the course nor the award of a in-service grant (which may be granted only by the Erasmus + National Agency). All applicants who will return this pre-registration form to AMSU duly completed will have to pass a pre-selection process undertaken by the course leaders.
Those who will considered eligible by the course leader to participate in the course will receive a pre-selection letter/Email.
The applicants who will be awarded the Erasmus + in-service grant by the National Agency of their country will have to inform AMSU they received the grant as soon as this information is available to them.
6.2) Cancellation policy relative to the Erasmus + courses:
Please note that cancellation of participation can only be made in writing (by regular mail or fax).
Cancellations received before receiving the official communication of the National Agency informing about the decision to award the grant to the participant(s) will entail no charge.
Cancellations received after receiving the official communication of the National Agency informing about the decision to award the grant to the participant(s) and received no later than fourteen days before the course starts, will entail a 15% of the course fee charge for administrative expenses.
Cancellation received after receiving the official communication of the National Agency informing about the decision to award the grant to the participant(s) and received later than fourteen days before the beginning of the course does not entitle the participant to any refund.
7.) Changes
7.1.) The tutors, course leaders, course organisers have the right to make changes in the syllabus within the limits of the subject announced.
7.2.) If a tutor is incapacitated through illness, the AMSU will assume the responsibility for replacing the tutor by another similarly qualified tutor. Also, if the planned materials or (technical) aids fail to function in time or properly, the AMSU will assume the responsibility for replacing them with similar materials or aids. In such cases the course participant is not entitled to partial or full refund of the course fee and the AMSU is not liable to make any compensation.
7.3.) If the AMSU considers that it is impossible to find a replacement of a similar kind, the course fee will be repaid entirely in the case of full cancellation and proportionally in the case of partial cancellation, after the deduction of a sum, to compensate the AMSU for reasonably incurred expenses, without the AMSU becoming liable for compensation.
8.) Miscellaneous
8.1.) The information on this website and any AMSU brochures have been compiled with care, but the AMSU is not liable for the inclusion of any incorrect or incomplete information.
8.2.) The AMSU also provides information via email and telephone as quickly as possible and maximum within 14 days. If the provision of information requires more than 14 days AMSU will respond with an aknowledgement of receipt of the request of information within 14 days, which will state when the AMSU will be able to provide the required information.
8.3.) The AMSU is not responsible for statements by and/or the behaviour of tutors and/or course participants towards one another. Nor is the AMSU liable for any injury caused by tutors, materials or aids, except in the case of deliberate intent or gross negligence on the part of the AMSU.
8.4.) The AMSU is not liable for the disappearance of the course participant's possessions through theft or loss.
8.5.) The AMSU retains the right to deny a course participant further admission to a course if the participant's behaviour, in the opinion of the tutors, course leader, course organisers, prevents the course from proceeding properly. In such a case the participant has no entitlement to refund of the course fee.
8.6.) The duration of the contract between AMSU and a participant starts with the submission of a complete application form - including confirming that the Terms & Conditions have been read and understood - and terminates at the end of the course, or in case of cancellation of an application or cancellation of the course and all relative applicable financial obligations of the parties are honoured.
8.7.) The course participant is not allowed to publish the course methodology and/or course material in whole or in part and/or to reproduce it except for personal study or use as defined in the Law on Copyright.
8.8.) All intellectual property rights of all AMSU course material remains with AMSU, besides if differently stated.
9.) Complaints and Disputes
9.1) Complaints from course participants should be made in written and signed. Complaints need to be addressed to The Board of The Amsterdam-Maastricht Summer University (AMSU). The Board will send an acknowledgement of receipt within 7 days from the date of receipt of a complaint. Within 28 days from the date of receipt of a complaint a proposal for a solution will be offered. Complaints will be archived for one (1) year.
9.2) If more time is needed to study the complaint, the course participant will be informed within the 28 days stating the reasons for the delay. The institute must indicate when it expects to come to an conclusion and inform the participant.
If the complaint has not been resolved and a dispute arises between the AMSU and a course participant, the dispute can be submitted to a third independant partie, in the person of Mr. Freek van Duijn, Co-Founder of Frame-Amsterdam, www.frame-amsterdam.nl. Costs that might accur will be borne by the partie who requests this second opinion. The verdict will be binding for AMSU. The institute is to take any measures required and to do so in 14 days.
9.3) All personal information provided to the AMSU will be treated confidentially and will not be disclosed to third parties without previous written consent of the concerned partie.
